Abstract: The royalty payment mechanism is a system of regular payments provided by the intellectual property owner to the user of this property for the right to exploit it. In the context of agriculture and crop production, royalties are regular payments to plant variety owners for the use of their breeding achievements. Despite the importance of this institution for stimulating innovation and protecting the interests of creators of new varieties, it faces a number of practical difficulties related to the lack of clear legislative norms and transparency of calculations. The amount of royalties is determined by current market conditions and, as a rule, is at a level comparable to the average indicators applied to similar types of activities within the industry in question. In the domestic legal sphere, the practice of transferring intellectual property rights has not yet become widespread, which leads to a shortage of market information necessary for making calculations. Thus, there is a need to develop methodological approaches to determining the reasonable cost of the initial product (soybean seeds) based on the application of market data.
